Creator Agreement
1. Scope
This Creator Agreement (“Agreement”) supplements our Terms of Service and applies when you create a creator profile or publish content on https://gamepassed.com.
2. Your representations
By publishing on GamePassed, you represent and warrant that:
- You are at least 18 years of age and legally permitted to distribute adult content in your jurisdiction.
- You own or have all necessary rights, licenses, and permissions to publish every game, image, audio file, and description you upload.
- All depicted characters in your content are 18 years of age or older, whether fictional or otherwise.
- Your content complies with our Acceptable Use Policy and applicable law.
- You maintain any records required by law for content you publish (see 2257 Statement if you include real-person explicit imagery).
3. Content license to GamePassed
You grant GamePassed a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and distribute your content solely to operate the Site (including thumbnails, previews, and download delivery to entitled buyers).
4. Payments
Unless you use integrated rails we explicitly offer:
- You are the merchant of record for sales you receive through external checkout links, license keys, or crypto addresses you configure.
- You are responsible for taxes, chargebacks, refunds, and compliance with payment processor rules.
- GamePassed may display an optional platform fee percentage you configure; fees are your responsibility to collect if applicable.
5. Uploads & security
Uploaded files are scanned for malware before storage. We may remove content that violates policy, receives valid legal notices, or poses security risk.
6. Takedowns & moderation
We may remove, restrict, or demote content at our discretion. Repeated violations may result in account termination without refund of any fees.
7. Indemnification
You agree to indemnify GamePassed against claims arising from your content, your sales practices, or your breach of this Agreement.
8. No employment
Creators are independent publishers, not employees or agents of GamePassed.
9. Termination
You may unpublish or delete content subject to technical limits and legal retention requirements. We may terminate creator access for violations.
