1. Agreement
By accessing https://gamepassed.com (the “Site”), operated by GamePassed (“we”, “us”, “GamePassed”), you agree to these Terms of Service (“Terms”), our Privacy Policy, Acceptable Use Policy, and (if you publish content) our Creator Agreement. If you do not agree, do not use the Site.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use the Site. The Site contains adult-oriented material. By using the Site you represent that you meet this requirement.
3. The Service
GamePassed is a marketplace that allows independent creators to list adult-oriented games and related media. We provide hosting, discovery, and account features. Unless explicitly stated otherwise:
- Payments are direct to creators. When you purchase through a creator’s external checkout link, license key, or configured payment rail, you pay the creator (or their payment processor), not GamePassed.
- GamePassed may charge creators an optional platform fee as disclosed on the Site.
- We do not guarantee the quality, safety, legality, or accuracy of creator content.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate registration information and keep it current. We may suspend or terminate accounts that violate these Terms or applicable law.
5. Purchases & licenses
Games are licensed by creators, not sold by GamePassed. License terms (personal use, redistribution, modding, etc.) are set by each creator and may vary. Refund requests for paid content should be directed to the creator or their payment processor according to their stated policy.
6. User conduct
You agree not to use the Site in violation of our Acceptable Use Policy, including uploading or distributing illegal content, harassing others, circumventing access controls, or attempting to compromise Site security.
7. Intellectual property
GamePassed’s name, branding, and Site software are our property. Creator content remains the property of its respective creators. See our DMCA Policy for copyright complaints.
8. Disclaimers
THE SITE AND CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GamePassed AND ITS OPERATORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR CREATOR CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
10. Indemnification
You agree to indemnify and hold harmless GamePassed from claims arising out of your use of the Site, your content, or your violation of these Terms or applicable law.
11. Termination
We may suspend or terminate access at any time for any reason, including violations of these Terms. Provisions that by their nature should survive termination will survive.
12. Changes
We may update these Terms by posting a revised version on the Site with a new “Last updated” date. Continued use after changes constitutes acceptance.
13. Governing law
These Terms are governed by the laws applicable to GamePassed’s place of establishment, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country provide otherwise.
