18 U.S.C. §2257 Statement
1. Platform nature
https://gamepassed.com is a user-generated content marketplace. GamePassed does not produce visual depictions of actual sexually explicit conduct. Creators upload and publish their own games and media.
2. Exemption
To the extent 18 U.S.C. §2257 and 28 C.F.R. Part 75 apply, GamePassed asserts that content on the Site consisting solely of animated, illustrated, or otherwise fictional adult material — with no real human performers engaged in actual sexually explicit conduct — is exempt from record-keeping requirements.
3. Creator responsibility
If a creator uploads content containing real persons engaged in actual sexually explicit conduct (including certain photorealistic or live-action material), that creator is solely responsible for:
- Maintaining all records required by §2257 and related regulations;
- Designating a custodian of records;
- Posting appropriate labeling on their content where required.
GamePassed may remove content that appears to include real-person explicit material without compliant records.
